Operation Of The Software Gold Club and Niche Gold
Club - and Refunds
- We reserve the right to withdraw, modify or
suspend the Software Gold Club and/or Niche Gold
Club and any associated services at any time, without
notice.
- Your Membership may be terminated by yourself or by us
at any time, without giving notice or reason. Where you
terminate your own membership or ask us to terminate it for
you, access to your membership will cease at the end of the
period for which you have already paid. Where we terminate
your membership, we may at our discretion terminate access
to your membership immediately with a refund of an
appropriate proportion of your most recent payment to
us. Once your membership has been terminated either by
yourself or by us, you must request our permission if you
wish to re-join the Niche Gold Club or Software Gold Club
and must not re-join unless this permission is
granted.
- You are only eligible to request a refund during your
first month of membership. If you receive a refund,
you are required to delete from your computers,
websites and backup devices, all software, ebooks,
articles and other material downloaded from the Niche
Gold Club and Software Gold Club members area. Once a refund
has been issued, you are no longer licensed to use, own or
sell any material obtained from the members area. In
addition, you are not eligible to re-join the Niche Gold
Club or Software Gold Club without our permission.
You are also not eligible for refunds on any other
memberships/software/services, now or at any time in the
future.
Software Gold Club - Restrictions On Selling Our Premium
Software
The Software Gold Club offers a standard solution of a
ready made, hosted software site that takes money directly
into the member's own Paypal account and delivers the
software to customers automatically. This is a highly
sophisticated, customizable private label solution. The system
allows members to optionally add their own header graphic and
autoresponder form to the software site and use their own
domain name. The system automatically private label brands all
the software with the members own details/links, including an
optional embedded ad. All software sites are set up
automatically and automatically updated with new software
every month.
The majority of members use this standard solution as-is as
a "zero hassle" method of selling the software and we
recommend that all new members use this system. However some
members have requested more flexibility, so we offer two
additional options.
One option allows members to upload the same software site
setup to their own web hosts, allowing members to modify the
web pages, add bonuses, use alternative payment services, set
up an affiliate program and change software
names.
The other option is to take individual product pages from
the software site and upload them separately to their own web
hosts. This option also allows members to modify the web
pages, add bonuses, use alternative payment services, set up
an affiliate program and change software names.
Note that for both these options, software must still be
sold in the same manner as if it were being sold from our
standard hosted software site solution. To clarify, the
following terms apply:
- Only current members of the Software Gold Club
may sell our Premium Software. If your membership is
cancelled, you are no longer able to sell our Premium
Software.
- People to whom you sell Premium Software (i.e. your
customers) are NOT permitted to sell it.
- Although the software is designed to look like it was
created by you, you don't own copyright to the software. You
are licensed to sell the software subject to these terms and
conditions.
- Premium Software must be sold (not given away).
- Premium Software must be sold alone. You may add your
own bonuses to this software, but must NOT use the software
as bonuses. The only exception to this rule is for cases
where we have bundled two of our products together as a
package for a discounted price (i.e. less than the normal
prices of the two products added together). In this case you
may sell the two products together as a discounted price
bundle. However you are only permitted to sell bundles
that we create. You are not permitted to create
your own software bundles.
- Premium Software must NOT be included in packages or
membership sites or sold on auction sites.
- You may offer an affiliate program when selling Premium
Software if you wish. Your affiliate program must not pay
more than 50% commissions. If you operate a 2-tier affiliate
program, the total commission payable on any sale should not
exceed 50% (2-tier affiliate programs are not generally
beneficial for this type of product).
- We set a standard selling
price for the Premium Software products and we ask
you to adopt this price (or more) and not to use any form of
coupon or rebate to discount the price. This helps to
maintain the value of the software for the benefit of all
our members.
If you do not understand these terms or do no wish to adopt
them, please stick to using our standard hosted software site
solution.
Software Gold Club - Additional Note On
Selling Our Premium Software
A
fundamental principle behind the club is that only a maximum
of 500 people are allowed to sell our Premium Software. Each
one of these people must be licensed to do this by being a
current full member of the Software Gold Club. We work very
hard to provide the best products and service for our members
and ask that you do not try to take unfair advantage of our
club. This is, after all, how we stay in business.
You
are not permitted to attempt to circumvent this principle in
any way. Examples of unacceptable activities include creating
a partnership/group to share a member account or setting up a
download area containing our software then allowing others to
sell access to it. If you are unsure about whether what are
planning is acceptable, please don't hesitate to contact us.
Software Gold Club - Restrictions On
"ViralPowerAds" Products
Our "ViralPowerAds" products
are primarily intended as an easy way to promote your Premium
Software and your business in general. The products all carry
full Master Resale Rights and usually allow you to give them
away, use them as bonuses, or sell them (and keep all the
money). Your customers can also sell them (and keep all the
money) too. However only Software Gold Club members can brand
the products, so this provides an easy way of spreading your
adverts across the Internet.
Note that
although the products contain your adverts and links, you
don't own copyright to them and are not permitted to
reverse engineer the products or modify them (other than by
using our supplied
brander).
IMPORTANT: These products
must only be branded by members. You are
NOT permitted to distribute the brander or
brand the products for someone else. If you have an affiliate
program, you are NOT permitted to
distribute the brander to your affiliates or brand the
products for your affiliates.
Software Gold Club - Membership Limit
The Software Gold Club is limited to a maximum of 500
full paying members who are permitted to sell our Premium
Software. When this limit is reached, the club will be closed
to new full paying members until such time as the number
of full paying members has dropped below 500.
Software Gold Club - Experienced Marketers
With Lists Of Over 10,000 Subscribers
Software Gold Club is primarily designed as a resource for
new marketers and includes resources of a kind not found in
other membership sites, designed to make it easy to set up an
income generating site. While we encourage and assist new
marketers to become successful, we do reserve the right
to impose conditions on the membership of anyone who
is already successful before joining the club. This is to
protect our existing members.
If you have an established successful business and/or
a list of over 10,000 subscribers, please contact us before
joining, including details of how you plan to sell the
software and whether or not you plan to promote Software Gold
Club. If you use any outsourcing or if more than one
person is involved with your business, please include that

Software Gold Club - Memberships For Groups,
Companies And Organisations
The standard
prices for the Software Gold Club and Niche Gold Club
are for individuals. It may be possible to accomodate
groups, companies and organisations through an appropriately
sized block membership at an appropriate rate. For pricing and
availability, please send us details of your requirements and
the size/details of your group, company or
organisation using our contact form.
Niche Gold Club - Restrictions On Use Of
Articles
The articles available through
the Niche Gold Club may be used however you want, with the
following exceptions:
1. You cannot pass on the Private Label rights to the
articles in any form. Only members are allowed to Private
Label the articles.
2. You cannot sell or give away the articles as "article
packs", even if you are not offering Private Label
rights, unless you include your own name, details and
link on the end of each article and a readme file
inside the package making it clear that the articles must not
be modified in any way.
If you cancel your membership, you may continue to use any
articles already downloaded (unless you request a refund, in
which case you must delete all articles and other material
downloaded).
Affiliate payments are made on or around the final day of
each month. Payments are for earnings from the previous
month. For example, commissions for any sales made in January
will be paid on or around the final day of February.
Commissions relating to fraudulent payments, refunds, etc.
will be deducted before commissions are paid. All
commissions are paid in US dollars via Paypal.com. There
is currently no alternative option for payment.
